On the 27th of February 2008, the German Federal Constitutional Court (Bundesverfassungsgericht) recognised in a landmark ruling for the first time a new constitutional right in the confidentiality and integrity of information technology systems. We will show in this case commentary why the Court found it necessary to introduce new legislation, and provide an overview of the newly established constitutional right.Downloads
