The goal of this article is to analyse relevant aspects related to innovative and preventive protection of intellectual property from the perspective of Portuguese law, paying special attention to the transposition of the Directive 2004/48/CE on measures and procedures to ensure the enforcement of intellectual property rights (Enforcement Directive). The article examines the Portuguese implementation of the Directive, paying particular care addressing issues relating to the presumptions of ownership and legitimacy under Community law.
